Welcome to LBScooters.com. The LBScooters.com website (the "Site") is comprised of various web pages operated by LB Scooters. ("LB Scooters."). LBScooters.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of LBScooters.com constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference.
LBScooters.com is a For Profit Site.
We specialize in vintage, classic and modern two-wheeled, and 3 wheeled, vehicle rental equipment.
Privacy
Your use of LBScooters.com is subject to LB Scooters.'s Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.
Electronic Communications
Visiting LBScooters.com or sending emails to LB Scooters. constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that LB Scooters. is not responsible for third party access to your account that results from theft or misappropriation of your account. LB Scooters. and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.
Children Under Thirteen
LB Scooters. does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use LBScooters.com only with permission of a parent or guardian.

LBScooters.com may contain links to other websites ("Linked Sites"). The Linked Sites are not under the control of LB Scooters. and LB Scooters. is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. LB Scooters. is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by LB Scooters. of the site or any association with its operators.
Certain services made available via LBScooters.com are delivered by third party sites and organizations. By using any product, service or functionality originating from the LBScooters.com domain, you hereby acknowledge and consent that LB Scooters. may share such information and data with any third party with whom LB Scooters. has a contractual relationship to provide the requested product, service or functionality on behalf of LBScooters.com users and customers.
No Unlawful or Prohibited Use/Intellectual Property
You are granted a non-exclusive, non-transferable, revocable license to access and use LBScooters.com strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to LB Scooters. that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site.
All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of LB Scooters. or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto.
You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. LB Scooters. content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of LB Scooters. and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of LB Scooters. or our licensors except as expressly authorized by these Terms.
Use of Communication Services
The Site may contain bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, "Communication Services"). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service.

LB Scooters. has no obligation to monitor the Communication Services. However, LB Scooters. reserves the right to review materials posted to a Communication Service and to remove any materials in its sole discretion. LB Scooters. reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.
LB Scooters. reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in LB Scooters.'s sole discretion.
Always use caution when giving out any personally identifying information about yourself or your children in any Communication Service. LB Scooters. does not control or endorse the content, messages or information found in any Communication Service and, therefore, LB Scooters. specifically disclaims any liability with regard to the Communication Services and any actions resulting from your participation in any Communication Service. Managers and hosts are not authorized LB Scooters. spokespersons, and their views do not necessarily reflect those of LB Scooters..
Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you upload the materials.

LB Scooters. does not claim ownership of the materials you provide to LBScooters.com (including feedback and suggestions) or post, upload, input or submit to any LB Scooters. Site or our associated services (collectively "Submissions"). However, by posting, uploading, inputting, providing or submitting your Submission you are granting LB Scooters., our affiliated companies and necessary sublicensees permission to use your Submission in connection with the operation of their Internet businesses including, without limitation, the rights to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Submission; and to publish your name in connection with your Submission.
No compensation will be paid with respect to the use of your Submission, as provided herein. LB Scooters. is under no obligation to post or use any Submission you may provide and may remove any Submission at any time in LB Scooters.'s sole discretion.
By posting, uploading, inputting, providing or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.
International Users
The Service is controlled, operated and administered by LB Scooters. from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the LB Scooters. Content accessed through LBScooters.com in any country or in any manner prohibited by any applicable laws, restrictions or regulations.
Indemnification
You agree to indemnify, defend and hold harmless LB Scooters., its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. LB Scooters. reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with LB Scooters. in asserting any available defenses.
Arbitration
In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms and Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration pursuant to the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or a similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator's award shall be final, and judgment may be entered upon it in any court having jurisdiction. In the event that any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its costs and reasonable attorney's fees. The parties agree to arbitrate all disputes and claims in regards to these Terms and Conditions or any disputes arising as a result of these Terms and Conditions, whether directly or indirectly, including Tort claims that are a result of these Terms and Conditions. The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.
Class Action Waiver
Any arbitration under these Terms and Conditions will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. THE PARTIES AGREE THAT A PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN EACH'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PUTATIVE CLASS, COLLECTIVE AND/ OR REPRESENTATIVE PROCEEDING, SUCH AS IN THE FORM OF A PRIVATE ATTORNEY GENERAL ACTION AGAINST THE OTHER. Further, unless both you and LB Scooters. agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding.

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. LB SCOOTERS. AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME.
LB SCOOTERS. AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. LB SCOOTERS. AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LB SCOOTERS. AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SITE, WITH THE DELAY OR INABILITY TO USE THE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF LB SCOOTERS. OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
Termination/Access Restriction
LB Scooters. reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of California and you hereby consent to the exclusive jurisdiction and venue of courts in California in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and LB Scooters. as a result of this agreement or use of the Site. LB Scooters.'s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of LB Scooters.'s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by LB Scooters. with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and LB Scooters. with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and LB Scooters. with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
Changes to Terms
LB Scooters. reserves the right, in its sole discretion, to change the Terms under which LBScooters.com is offered. The most current version of the Terms will supersede all previous versions. LB Scooters. encourages you to periodically review the Terms to stay informed of our updates.

Rental Terms and Conditions

CUSTOMER ORIENTATION
Every client may receive a video orientation to the motorcycle, scooter, e-bike, electric scooter, or moped they are renting before or at the time of the rental or alternatively at the time of drop-off, we conduct a client orientation that covers all aspects of safe motorcycle, scooter, moped operation, equipment maintenance as well as local and state laws.
FUEL
LB SCOOTERS provides a full tank of gas for every vehicle at the start of each rental period. The customer is not responsible for returning the rental full of gas. HOWEVER, during the rental, LB SCOOTERS claims no responsibility for motorcycle, scooter, moped fuel consumption and mileage during the rental period. Fueling costs during the rental are the client's responsibility and are required to follow the special fueling instructions given at the time of delivery or sent in the introduction email as well as the safety training video.
HELMETS (INCLUDED IN DAILY RENTAL RATE)
Helmets are provided with all motorcycle, scooter, e-bike, electric scooter, or moped rentals. Clients are encouraged to bring their own helmets for comfort and style. Helmets are required by law in all locations. Failure to comply to the law by wear a helmet during the rental will result in the renter assuming all legal responsibility for breaking the law and any fees, fines, or penalties due to those actions.
INSURANCE
Customer are required to have daily liability insurance to rent from LB SCOOTERS’s. The current daily insurance rate is included in the rental package selected by the renter. This provides the renter with the minimum limits required by any applicable compulsory or financial responsibility law. This mandatory daily liability insurance is purchased in renter’s name from LB SCOOTERS’s insurance company. LB SCOOTERS provides no vehicle insurance coverage to renter and no coverage to the renter or rental equipment in case of accident or injury.
ADDITIONAL PASSENGER FOR 50CC VESPA SCOOTERS & MOTORCYCLE ONLY (NO E-BIKE, OR MOPED)
1 additional PASSENGER is permitted at no extra charge, but is not allowed to operate the vehicle, but only to participate as a passenger ONLY. The minimum age for the passenger is 18 years of age and a photo ID is required.
ADDITIONAL DRIVERS FOR MOTORCYCLE ONLY (NO E-BIKE, SCOOTER, OR MOPED)
1 additional driver is permitted at no extra charge. The minimum age for an additional driver is 21 and a valid motorcycle, scooter, license is required.
MAINTENANCE RESPONSIBILITY
The customer is responsible for checking engine oil levels at each refueling and reporting mechanical failures immediately. Instructions and procedures for maintenance expense are provided at pick-up. Customers may be held responsible for mechanical damage due to negligence in motorcycle, scooter, e-bike, electric scooter, or moped operation or failure to provide normal maintenance.
MOTORCYCLE, SCOOTER, E-BIKE, ELECTRIC SCOOTER, OR MOPED SUBSTITUTION
LB SCOOTERS reserves the right to substitute the motorcycle, scooter, e-bike, electric scooter, or a moped confirmed to rental client. Should LB SCOOTERS not be able to provide confirmed motorcycle, e-bike, electric scooter, or moped scooter of a similar or better model will be provided to the client. This constitutes the maximum liability of LB SCOOTERS.
SECURITY DEPOSIT
A security deposit will be taken at delivery / drop-off (Authorization Only) and must be processed via valid credit card, debit card, cashier check or cash. The amount of the Security Deposit to be held will be the customer’s estimated rental charges of $2,000 - $3,000 per motorcycle/scooter and $1,000 per moped, whichever is greater. The Security Deposit shall be released after vehicle(s) and accessories pickup date subject to and contingent upon terms in the rental agreement.
RESTRICTIONS
Violation of listed restrictions voids all claims and client will be held liable for damages. Road Restriction: Rental street motorcycle, scooter, e-bike, electric scooters, or mopeds are not allowed on gravel roads, beaches, logging or other non-public roads. Leaving the Motorcycle, scooter, e-bike, electric scooters, or mopeds uplocked will result in the client (renter) being held liable for the theft or damages. Leaving the equipment in an unsecure location will result in the client (renter) being held liable for the theft or damages. Mexico Restriction: Clients cannot enter Mexico on a USA bike without written authorization or accompanied by an LB SCOOTERS Guide. Death Valley WARNING: Entering Death Valley during the months of June & August is dangerous and not recommended.

LB SCOOTERS Fees & Fines:
1. The use of a driving rental for photoshoots or filming purposes will be charged the full rate for the filming and photoshoot use. This is to prevent the prevent people from abusing our services, insurance, and equipment.
2. Anyone caught breaking the law OR our agreement (use of photos, video footage, police, or eye witnesses) will be fined $500 for breaking our agreement and will be black listed from using our rentals in the future.
RESERVATION AND DEPOSIT
For reservations, all rental charges, addons, taxes, etc. must be paid for at the time of booking that holds your reservations. The security deposit will be collected at the time of the delivery / drop-off.
DELIVERY / PICK-UP, RETURN & LATE CHARGES
Delivery and pick-up time of rental motorcycle, scooter, e-bike, electric scooter, or moped is performed during the LB Scooters business hours.
Rental Durations:
1. 2 Hour rental is based on 2-hour period starting from the time of pick-up.
2. 4 Hour rental is based on 4-hour period starting from the time of pick-up.
3. 8 Hour (FULL DAY) rental is based on 8-hour period starting from the time of pick-up until the end of the business day.
4. 24 Hour rental is based on a 24-hour rental period starting from the time of pick-up.
5. No refunds for early motorcycle, scooter, e-bike, electric scooter, or moped returns are granted.
Customer Late Charge:
1. A $25 per hour penalty is assessed if the motorcycle, scooter, moped is returned late from scheduled delivery / pick-up time.
2. After business hour late fees are double the late hourly rate
3. A grace period of 10 min is provided to the renter

LB SCOOTERS Late Charges: Deliver and Pickup customer’s vehicle(s) and accessories promptly per the customer’s booking reservation. However, seldom there may be circumstances such as traffic accidents, road closures, etc., where prompt delivery and pickup may not be possible. Thus, in the unlikely event customer’s vehicle(s) and accessories are not delivered or picked up within one (1) hours after customer’s scheduled delivery time or pickup time (“Late Delivery” or “Late Pickup”), customer shall be entitled to the following:
a. Late Delivery – Customer may elect to cancel the reservation and shall receive a full refund of the Booking/Reservation Deposit, or if customer elects to proceed with the rental customer shall receive a rental charge credit for the full amount of the Booking/Reservation Deposit.
b. Late Pickup – Customer shall receive a rental charge credit in the amount of 20% of the total rental charges due upon pickup.
CANCELLATION AND REFUNDS
All reservations are final and non-refundable except for the following scenarios. Requests for refunds will be reviewed by LB SCOOTERS Customer Service and will be at the sole discretion of the company.
1. 8+ Days: A reservation may be cancelled up to 7 day or more prior to the delivery date with no cancellation penalty.
2. 5-7 Days: 30% of the total will be applied towards cancellation fee if the booking is canceled between 7-5 days from of delivery day/time.
3. 3-4 Days: 60% of the total will be applied towards cancellation fee if the booking is cancelled between 4-3 days from the delivery day/time.
4. 0-2 Days: 100% of the total will be applied towards cancellation fee if the booking is cancelled within 2 days from delivery day/time or if the customer does not show up.
Please note: A $10 admin fee will be applied to a reservation that is modified between 7 - 1 days before delivery day/time.
PAYMENT METHODS
LB SCOOTERS accepts the following methods of payment: Cash, Travelers Cheques, VISA, Master Card, or AMEX.
BOOKING TERMS
Reservation must be paid in full to guarantee rate and rental date.
Reservations are non-refundable.
Discount rates are subject to blackout dates and availability.
All rental models and rates vary by season.
INTERNATIONAL USERS
The Service is controlled, operated and administered by LB Scooters. from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws.
WAIVER COVERAGE
All Theft and Damage Waivers and Supplemental Liability Insurance options are subject to the express terms and conditions of the rental contract and do not include coverage for injury, personal property, or damage as the result of negligence such as illegal use or use of rental while under the influence of drugs or alcohol. A Police Report is required for all damages or accidents. All damages to rented motorcycle, scooter, without a police report will be considered to be at the fault of the Renter.
Supplemental Liability Insurance provides supplemental third-party liability insurance at limits excess of state-required minimum financial responsibility limits.
Please note that SLI is supplemental and secondary to all other available insurance where permitted by law.
RELEASE OF LIABALITY
BY USING LB SCOOTERS SERVICE & PRODUCTS, I hereby grant LB Scooters release of liability for any and all activities that I take during the course of my rental. I assume full responsibility for my actions while driving and I take full legal responsibilities of the outcome of those actions. Any unlawful actions taken by the renters is fully on the renter and not LB Scooters. I do not hold LB Scooters responsible for any injuries or damage that comes from my using their rental equipment. I am willing accepting the rental as is and take full responsibly while in my possession.
BY USING LB SCOOTERS SERVICE & PRODUCTS I hereby agree to indemnify, defend and hold harmless LB Scooters., its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. LB Scooters. reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with LB Scooters. in asserting any available defenses.
BY USING LB SCOOTERS SERVICE & PRODUCTS, I hereby grant permission to LB Scooters the rights of my image, in video or still, and of the likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording. I also understand that this material may be used in diverse educational settings within an unrestricted geographic area. Photographic, audio or video recordings may be used for ANY USE which may include but is not limited to presentations, courses, online/internet videos, media, news / press.
BY USING LB SCOOTERS SERVICE & PRODUCTS, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public educational setting. I will be consulted about the use of the photographs or video recording for any purpose other than those listed above. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed. This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document only.
BY USING LB SCOOTERS SERVICE & PRODUCTS, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for educational purposes.
